Chapter 7 – Privacy, Data Protection & Media Policy

96. Purpose of this Chapter
Zero Boundary respects the privacy, dignity, and personal information of every Participant and Parent/Guardian.
This Chapter explains how Zero Boundary collects, uses, stores, protects, shares, and retains personal information in connection with its Programs, website, digital platforms, and related services.

Zero Boundary is committed to handling personal data responsibly and in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and other applicable laws of India.

97. Information We Collect
Zero Boundary may collect information necessary for the safe administration and delivery of its Programs.

Such information may include:

• Address

• School or educational institution

• Contact information

Parent / Guardian Information

• Name

• Relationship with Participant

98. Purpose of Data Collection
Information is collected solely for legitimate educational, administrative, operational, safety, and legal purposes.

• Parent communication

• Issuing certificates

• Improving educational services

Zero Boundary shall collect only such information as is reasonably necessary for these purposes.

99. Consent for Data Processing
By registering for a Zero Boundary Program, the Parent/Guardian provides consent for the collection and processing of personal information necessary for the administration of the Program.

Where required by applicable law, additional consent may be obtained for specific purposes.

Parents may withdraw consent where legally permissible; however, such withdrawal may affect Zero Boundary's ability to provide certain services or allow continued participation in a Program.

100. Confidentiality
Zero Boundary treats Participant information with appropriate confidentiality.

Personal information shall only be accessed by authorised personnel who reasonably require such information for:

• Participant safety

• Program administration

• Medical response

• Legal compliance

• Operational management

All staff members, instructors, volunteers, and authorised representatives are expected to maintain confidentiality regarding Participant information.

101. Sharing of Information
Zero Boundary does not sell, rent, or commercially exploit the personal information of Participants or Parents.

Information may only be shared where reasonably necessary, including:

• Medical professionals during emergencies.

• Hospitals and emergency responders.

• Government authorities where required by law.

• Insurance providers where applicable.

• Payment service providers.

• Technology service providers assisting Program operations.

• Educational partners directly involved in delivering the Program.

Only the minimum information reasonably necessary shall be shared.

102. Data Security
Zero Boundary shall implement reasonable administrative, technical, and organisational measures to protect personal information against:

• Unauthorised access

• Unauthorised disclosure

• Loss

• Misuse

• Alteration

• Destruction

Although reasonable precautions are taken, no electronic system or method of data transmission can be guaranteed to be completely secure.

103. Data Retention
Personal information shall be retained only for as long as reasonably necessary to:

• Deliver Programs.

• Maintain educational records.

• Comply with legal obligations.

• Resolve disputes.

• Protect the legitimate interests of Zero Boundary.

Thereafter, information may be securely deleted, anonymised, or archived in accordance with applicable law.

104. Participant Records
Zero Boundary may maintain records relating to a Participant's involvement in its Programs, including:

• Attendance

• Program participation

• Medical incidents

• Behavioural records

• Safety reports

• Certificates

• Awards

• Financial transactions

• Parent communications

Such records help ensure continuity, safety, quality improvement, and legal compliance.

105. Photography & Videography
Experiential learning often involves documenting educational experiences.

Accordingly, Zero Boundary or persons authorised by Zero Boundary may photograph, film, audio-record or otherwise record Participants and Program activities for legitimate purposes including: 

• Educational documentation

• Parent communication

• Training of staff

• Internal quality improvement

• Safety review

• Marketing and promotional materials

• Website and social media content

• Publications and annual reports

• Legal, insurance and evidentiary purposes 

Zero Boundary shall make reasonable efforts to ensure that such media is used responsibly and in a manner that is respectful, appropriate, and consistent with the dignity, privacy and safety of Participants. 

Nothing in this clause shall prevent Zero Boundary from capturing, retaining or using photographs, videos, audio recordings or other media where reasonably necessary for safety, safeguarding, incident investigation, legal compliance, insurance, evidentiary, administrative or other legitimate organisational purposes, subject to applicable law. 

106. Consent for Media Usage
For Participants below eighteen (18) years of age, the use of identifiable photographs, videos, audio recordings or other media for external promotional or publicity purposes shall be subject to the consent mechanism communicated or provided by Zero Boundary to the Parent/Guardian, to the extent required by applicable law. 

Where such consent is provided, the permitted  usage may include:

• Official website

• Social media platforms

• Brochures

• Presentations

• Advertisements

• News articles

• Educational publications

• Event reports

• Fundraising material

• Internal training resources

Consent may be obtained through a separate consent form, registration checkbox, digital confirmation or such other mechanism as Zero Boundary may reasonably prescribe.

A Parent/Guardian may withdraw consent for future promotional use by following the procedure specified by Zero Boundary, subject to applicable law and reasonable practical limitations relating to photographs, videos or other media that have already been lawfully published, distributed, printed, archived or otherwise made available before withdrawal.

Zero Boundary shall not knowingly use Participant media in a manner that is defamatory, misleading, or harmful to the Participant's dignity.
Where required by law or where a Parent/Guardian specifically opts out through the prescribed process, Zero Boundary shall respect such preferences to the extent reasonably practicable.

Nothing in this clause prevents Zero Boundary from retaining or using media where reasonably necessary for safety, safeguarding, legal, insurance, evidentiary or administrative purposes, even where promotional consent has been withdrawn, subject to applicable law. 

107. CCTV & Security Monitoring
For the safety and security of Participants, staff, visitors, and property, certain Program locations or facilities may utilise CCTV or other lawful security monitoring systems.
Recordings may be used for:

• Safety monitoring

• Incident investigation

• Security purposes

• Legal compliance

• Protection of persons and property

CCTV recordings shall not ordinarily be used for unrelated purposes.

108. Website Cookies
The Zero Boundary Website may use cookies or similar technologies to:

• Improve user experience.

• Remember user preferences.

• Analyse website usage.

• Improve website performance.

• Enhance security.

Users may manage cookie preferences through their browser settings; however, disabling certain cookies may affect website functionality.

109. Third-Party Digital Services
Zero Boundary may utilise trusted third-party service providers for:

• Payment processing

• Email communication

• Registration management

• Cloud storage

• Video conferencing

• Analytics

• Learning management

• Customer support

These service providers operate under their own privacy policies and legal obligations.

Zero Boundary shall endeavour to engage reputable providers that maintain reasonable standards of data protection.

110. Parent & Participant Rights
Subject to applicable law, Parents/Guardians may request:

• Access to personal information.

• Correction of inaccurate information.

• Updating of personal records.

• Withdrawal of consent where legally permissible.

• Deletion of information where applicable.

• Clarification regarding the use of personal data.

Requests may be made through the official contact details published by Zero Boundary.

111. Children's Privacy
Zero Boundary recognises that the privacy of children requires special care.
Personal information relating to Participants below eighteen (18) years of age shall ordinarily be collected only through a Parent or Legal Guardian or with appropriate parental authorisation.

Zero Boundary shall take reasonable measures to safeguard children's personal information and process such information solely for legitimate educational, safety, administrative, and legal purposes.

112. Data Breach Response
In the unlikely event of a significant data breach affecting personal information, Zero Boundary shall take reasonable steps to:

• Contain the incident.

• Assess the impact.

• Notify affected individuals where required by law.

• Cooperate with relevant authorities where applicable.

• Implement corrective measures to reduce the likelihood of recurrence.

113. Changes to this Privacy Policy
Zero Boundary may update this Chapter from time to time to reflect:

• Changes in law.

• Technological developments.

• Operational improvements.

• Educational requirements.

• Organisational changes.

The latest version shall be published on the official Website and shall become effective upon publication unless otherwise stated.

114. Parent Acknowledgement
By registering a Participant for a Zero Boundary Program, the Parent/Guardian acknowledges that they:

• Have read and understood this Chapter.

• Consent to the collection and processing of personal information as described herein.

• Understand the purposes for which information may be used.

• Acknowledge the media policy and photography provisions.

• Understand their rights regarding personal information under applicable law.

• Agree to notify Zero Boundary of any changes to personal information during the Participant's involvement with the organisation.

Chapter 8 – Educational Philosophy, Learning Outcomes & Intellectual Property

115. Purpose of this Chapter
Zero Boundary is an experiential learning organisation dedicated to developing practical life skills, character, leadership, resilience, financial literacy, and responsible citizenship through carefully designed educational experiences.

This Chapter explains the educational philosophy of Zero Boundary, clarifies learning expectations, defines the use of educational resources and technology, and protects the intellectual property associated with the organisation's Programs.

116. Educational Philosophy
Zero Boundary believes that meaningful education extends beyond textbooks and examinations.

Our Programs are designed to complement formal education by providing opportunities for Participants to develop practical knowledge, life skills, emotional intelligence, leadership, teamwork, creativity, critical thinking, and responsible decision-making through direct experience.

Learning is achieved through participation, observation, reflection, experimentation, discussion, and application rather than passive instruction alone.

117. Nature of Experiential Learning
Experiential learning places Participants in structured situations where they actively engage with real-world challenges under the guidance of qualified instructors.

Programs may include:

• Financial literacy simulations

• Entrepreneurship activities

• Leadership exercises

• Adventure education

• Outdoor learning

• Swimming

• Krav Maga

• Team-building exercises

• Nature exploration

• Community engagement

• Environmental education

• Problem-solving activities

• Creative workshops

• Reflection sessions

• Practical demonstrations

Each activity is designed with defined educational objectives appropriate to the age and developmental stage of Participants.

118. Learning Objectives
The primary objectives of Zero Boundary Programs include developing:

• Self-confidence

• Independence

• Leadership

• Communication skills

• Teamwork

• Problem-solving ability

• Critical thinking

• Financial awareness

• Decision-making skills

• Responsibility

• Emotional resilience

• Adaptability

• Respect for nature

• Social responsibility

• Ethical conduct

Programs are educational in nature and are not intended solely for recreation or entertainment.

119. Individual Learning Outcomes
Every Participant learns differently.

Educational outcomes depend upon numerous factors including:

• Individual participation

• Personal motivation

• Age and maturity

• Prior experiences

• Physical ability

• Emotional readiness

• Group dynamics

• Duration of participation

• Personal reflection and continued practice

Accordingly, Zero Boundary does not guarantee identical outcomes for every Participant.

120. No Guarantee of Specific Results
While Zero Boundary is committed to delivering high-quality experiential education, participation in a Program does not guarantee any particular:

• Academic improvement

• Behavioural change

• Leadership position

• Career opportunity

• Financial success

• Physical transformation

• Emotional development

• Sporting achievement

• Competitive advantage

Zero Boundary provides opportunities for learning and personal development; however, the extent of benefit depends upon each Participant's individual engagement and circumstances.

121. Financial Literacy Simulation
Certain Programs include educational simulations relating to:

• Money management

• Budgeting

• Banking

• Saving

• Investing

• Insurance

• Entrepreneurship

• Business decision-making

• Economic systems

These simulations are conducted solely for educational purposes.

Any fictional currency, simulated bank accounts, investment exercises, or business activities used during Programs are educational tools and do not represent actual financial products or services.

Nothing taught during these simulations shall be interpreted as financial, investment, tax, legal, or professional advice.
Participants and Parents/Guardians should seek independent professional advice before making real-world financial decisions.

122. Entrepreneurship Activities
Entrepreneurship exercises conducted during Programs are intended to develop creativity, innovation, communication, teamwork, budgeting, ethical decision-making, and problem-solving.

Business simulations undertaken during Programs are educational exercises only.

Participation in such activities does not create any business partnership, employment relationship, investment opportunity, or financial obligation between Participants and Zero Boundary.

123. Artificial Intelligence & Educational Technology
Zero Boundary may utilise modern educational technologies, including Artificial Intelligence (AI), digital learning platforms, educational software, simulations, and interactive learning tools to enhance the learning experience.

While such technologies are selected with care, Participants and Parents acknowledge that AI-generated content may occasionally contain inaccuracies, outdated information, or incomplete responses.

Participants are encouraged to:

• Think critically.

• Verify important information.

• Discuss uncertainties with instructors.

• Use technology responsibly and ethically.

AI tools are intended to supplement, not replace, human instruction, judgement, or professional guidance.

124. Educational Materials
Participants may receive educational materials including:

• Workbooks

• Handbooks

• Activity sheets

• Videos

• Digital resources

• Presentations

• Games

• Learning kits

• Assessments

• Reflection journals

These materials are provided solely for educational use in connection with Zero Boundary Programs.
Participants shall use these materials responsibly and in accordance with applicable copyright laws.

125. Certificates & Recognition
Zero Boundary may issue certificates, awards, badges, recognitions, or participation acknowledgements upon successful completion of a Program.

Such recognitions:

• Reflect participation or achievement within the Program.

• Do not constitute academic qualifications.

• Do not imply government recognition unless expressly stated.

• Shall not be altered or misrepresented.

Zero Boundary reserves the right to withhold certificates where a Participant fails to satisfy reasonable Program requirements or engages in serious misconduct.

126. Intellectual Property
Unless otherwise stated, all intellectual property associated with Zero Boundary is owned by or licensed to Zero Boundary.
This includes, but is not limited to:

• Program curriculum

• Lesson plans

• Activity designs

• Educational games

• Financial simulations

• Training methodologies

• Logos

• Trademarks

• Website content

• Videos

• Photographs

• Graphics

• Documents

• Software

• Mobile applications

• Digital platforms

• Printed materials

• Assessment tools

• Teaching resources

All intellectual property rights are reserved.

127. Restrictions on Use
Without prior written permission from Zero Boundary, Participants and Parents/Guardians shall not:

• Copy educational materials for commercial purposes.

• Reproduce Program content.

• Record complete training sessions for public distribution.

• Sell or distribute educational resources.

• Modify copyrighted materials.

• Use Zero Boundary branding without authorisation.

• Create derivative commercial works based on Program content.

Reasonable personal educational use is permitted unless otherwise specified.

128. Participant-Created Work
Participants may create projects, presentations, artwork, business ideas, inventions, written reflections, or other original work during Programs.

Ownership of such original work generally remains with the Participant.

However, the Participant and Parent/Guardian grant Zero Boundary a non-exclusive, royalty-free permission to display, reproduce, or showcase such work for educational, training, promotional, or archival purposes, unless the Parent/Guardian expressly objects in writing before such use.

Zero Boundary shall make reasonable efforts to acknowledge Participants where appropriate.

129. Feedback & Suggestions
Zero Boundary welcomes suggestions from Participants and Parents regarding improvements to its Programs.

Unless otherwise agreed in writing, any suggestions, recommendations, ideas, or feedback voluntarily submitted may be used by Zero Boundary without obligation to provide compensation or attribution.

Such use shall not affect the ownership of independently created intellectual property belonging to the Participant.

130. Ethical Learning Environment
Zero Boundary is committed to fostering an educational environment based on:

• Honesty

• Curiosity

• Respect

• Responsibility

• Inclusion

• Collaboration

• Innovation

• Environmental stewardship

• Ethical decision-making

Participants are encouraged to approach every activity with integrity, openness, and a willingness to learn from both success and failure.

131. Parent Acknowledgement
By registering a Participant for a Zero Boundary Program, the Parent/Guardian acknowledges that they:

• Understand the experiential learning philosophy of Zero Boundary.

• Recognise that learning outcomes vary among individuals.

• Understand that educational simulations are conducted solely for learning purposes.

• Acknowledge that AI and digital tools may be used to enhance education.

• Agree to respect the intellectual property rights of Zero Boundary.

• Support the Participant's active involvement in the learning process.

Chapter 9 – Liability, Insurance, Indemnity & Legal Responsibility

132. Purpose of this Chapter
Experiential learning involves shared responsibility between Zero Boundary, Participants, and Parents/Guardians.
While Zero Boundary is committed to maintaining a safe, well-supervised, and professionally managed learning environment, certain risks are inherent to outdoor education and practical learning experiences.

This Chapter explains the legal responsibilities of each party, the limits of Zero Boundary's liability, insurance considerations, indemnity obligations, and the role of third-party service providers.

133. Duty of Care
Zero Boundary is committed to exercising reasonable care in planning, organising, supervising, and conducting its Programs.
This includes, where reasonably practicable:

• Risk assessments

• Qualified instructors

• Safety briefings

• Appropriate supervision

• Emergency preparedness

• Inspection of equipment

• Activity planning

• First-aid preparedness

• Participant welfare

However, the duty of care does not eliminate all risks associated with experiential learning, outdoor activities, or group participation.

134. Assumption of Inherent Risk
Parents/Guardians acknowledge that certain risks are naturally associated with experiential learning, outdoor education, sports, travel, and physical activities.

Such risks may include, but are not limited to:

• Slips, trips, and falls

• Minor injuries

• Muscle strains

• Fatigue

• Environmental exposure

• Weather-related conditions

• Water-related risks

• Insect bites

• Wildlife encounters

• Equipment failure despite reasonable maintenance

• Unexpected participant behaviour

• Transportation delays

• Natural hazards

Participation constitutes acknowledgment that these inherent risks cannot be completely eliminated despite reasonable safety measures.

135. Limitation of Liability
To the maximum extent permitted by applicable law, Zero Boundary shall not be liable for indirect, incidental, consequential, exemplary, or special damages arising out of participation in its Programs.

This includes, where permitted by law:

• Loss of opportunity

• Loss of income

• Emotional distress unrelated to negligence

• Business interruption

• Loss of reputation

• Loss of academic opportunity

• Indirect financial losses

Zero Boundary shall not be liable for losses arising solely from risks inherent in the relevant activity or from circumstances beyond its reasonable control, where Zero Boundary has exercised reasonable care as required by applicable law. 

Nothing in these Terms excludes liability that cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct or other circumstances for which exclusion or limitation is prohibited by law. 

136. No Guarantee of Absolute Safety
Zero Boundary strives to create a safe environment through planning, supervision, and risk management. However, no educational organisation can guarantee:

• Absolute safety

• Complete prevention of accidents

• Elimination of environmental hazards

• Elimination of human error

• Elimination of natural risks

Parents acknowledge that participation involves managed risk rather than risk-free activity.

136 A. Inherent Natural Hazards
To the maximum extent permitted by applicable law, Zero Boundary shall not be responsible for loss, injury, damage or inconvenience arising solely from natural, environmental or other inherent hazards associated with the relevant Program or activity, provided that Zero Boundary has exercised reasonable care and complied with its obligations under applicable law.

Such hazards may include, where relevant, weather conditions, terrain, altitude, water conditions, natural features, wildlife, insects, falling objects, uneven surfaces, environmental conditions and other naturally occurring or inherent conditions that cannot reasonably be eliminated without fundamentally changing the nature of the activity.

Nothing in this clause excludes or limits liability that cannot lawfully be excluded or limited.

137. Personal Property
Participants are responsible for the care and security of their personal belongings.

Zero Boundary shall not ordinarily be responsible for loss, theft, or damage to personal items including:

• Mobile phones

• Smart watches

• Cameras

• Jewellery

• Cash

• Wallets

• Clothing

• Electronic devices

• Personal equipment

Participants are encouraged to avoid bringing unnecessary valuables unless specifically required for the Program.

138. Damage Caused by Participants
Parents/Guardians accept responsibility for intentional or negligent damage caused by the Participant to:

• Program equipment

• Accommodation

• Vehicles

• Educational materials

• Property belonging to partner organisations

• Property belonging to other Participants

• Natural environments where restoration costs arise

Zero Boundary reserves the right to recover reasonable repair or replacement costs where appropriate.

139. Third-Party Service Providers
Certain aspects of a Program may involve independent third-party service providers, including but not limited to:

• Transportation providers

• Accommodation providers

• Catering services

• Medical facilities

• Equipment suppliers

• Activity specialists

• Venue operators

• Adventure instructors

• Emergency services

Where Zero Boundary engages a third-party service provider, that provider shall remain independently responsible for the services, acts and omissions falling within its own contractual or legal responsibilities. Zero Boundary may rely upon the provider's independent expertise, qualifications, facilities and operational arrangements to the extent reasonably appropriate to the services being provided 
However, the engagement of a third-party service provider shall not relieve Zero Boundary of any duty, responsibility or liability imposed upon Zero Boundary by applicable law. 

Nothing in this clause shall be construed as making Zero Boundary responsible for losses or failures attributable solely to the independent acts or omissions of a third-party service provider, except to the extent that applicable law imposes responsibility upon Zero Boundary. 

140. Transportation
Where transportation is arranged by or through Zero Boundary, reasonable efforts shall be made to engage suitable transport providers.
Parents acknowledge that road travel and transportation involve risks beyond the direct control of Zero Boundary, including:

• Traffic congestion

• Mechanical failure

• Weather conditions

• Road closures

• Delays caused by third parties

Reasonable precautions shall nevertheless be taken when organising transportation.

141. Insurance
Zero Boundary may maintain such insurance policies as it considers appropriate for its operations and Programs, subject to the terms, conditions, limits, exclusions, deductibles and other provisions of the relevant insurance policies.
However, Parents/Guardians acknowledge that such insurance:

• May not cover every circumstance, Participant, activity, event, loss or  

• May be subject to exclusions and limitations.

• Does not replace personal health, travel, cancellation, baggage, other personal  or accident insurance coverage to Participants. 

Parents are strongly encouraged to maintain appropriate medical, accident, travel, and personal insurance for the Participant where appropriate having regard to the nature, location and risks of the relevant Program. 

No representation or assurance is made that any particular loss, injury, expense or circumstance will be covered by any insurance maintained by Zero Boundary.

Nothing in this clause shall be interpreted as excluding, limiting or transferring any liability that Zero Boundary is legally required to bear.

142. Medical Expenses
Unless expressly covered by Zero Boundary's insurance or otherwise agreed in writing, Parents/Guardians remain responsible for:

• Hospital expenses

• Ambulance charges

• Prescription medication

• Diagnostic tests

• Specialist consultations

• Follow-up treatment

• Rehabilitation

• Other healthcare costs arising from the Participant's medical care

Zero Boundary shall make reasonable efforts to assist during emergencies but cannot assume financial responsibility for medical treatment except where required by law.

143. Force Majeure
Zero Boundary shall not be liable for delays, interruptions, cancellations, or inability to perform its obligations where such events arise from circumstances beyond its reasonable control.
Examples include:

• Natural disasters

• Floods

• Earthquakes

• Storms

• Lightning

• Fire

• Epidemics

• Pandemics

• Government restrictions

• Civil unrest

• War

• Terrorist incidents

• Labour disputes

• Power failures

• Internet outages

• Venue closures

• Transportation disruptions

• Other unforeseeable events

Where reasonably practicable, Zero Boundary shall endeavour to communicate with Participants and provide suitable alternatives.

144. Indemnity
To the extent permitted by applicable law, the Parent/Guardian agrees to indemnify and hold harmless Zero Boundary, its founders, directors, employees, instructors, volunteers, consultants, authorised representatives, and partner organisations against losses, claims, liabilities, damages, or expenses arising directly from:

• knowingly false or materially misleading declarations made by the Parent/Guardian or Participant during registration;

• material non-disclosure of information reasonably relevant to the Participant's safe participation in the Program;

• deliberate or negligent damage to property belonging to Zero Boundary or third parties caused by the Participant;

• unlawful, wilfully wrongful or materially negligent conduct of the Participant or Parent/Guardian; or any other conduct of the Participant or Parent/Guardian for which responsibility may lawfully be imposed under applicable law.

• Wilful violation of Program rules.

• Breach of these Terms by the Parent/Guardian or Participant.

The indemnity shall not apply to the extent that the relevant loss, liability or expense arises from the negligence, wilful misconduct or other legally actionable conduct of Zero Boundary or from any liability that cannot lawfully be transferred to the Parent/Guardian.

Any amount recoverable under this clause shall be limited to reasonable losses and expenses actually incurred and legally recoverable under applicable law.

144 A. Acknowledgement of Inherent Risks 
The Parent/Guardian and Participant acknowledge that participation in experiential learning, outdoor activities, sports, travel, physical activities, adventure activities and other Programs may involve inherent risks that cannot be completely eliminated despite reasonable precautions.

To the maximum extent permitted by applicable law, the Participant and Parent/Guardian accept responsibility for risks that are inherent in and ordinarily associated with the relevant activity and that have been reasonably disclosed by Zero Boundary or are reasonably apparent from the nature of the activity.

This acknowledgement does not constitute a waiver, release or exclusion of claims arising from negligence, wilful misconduct, fraud, breach of a non-excludable statutory duty, or any other liability that cannot lawfully be excluded or limited.

Nothing in this clause prevents a Participant or Parent/Guardian from exercising any statutory right or pursuing any remedy that cannot lawfully be waived or excluded.

145. Limitation Regarding Learning Outcomes
Participation in a Program does not create any guarantee of:

• Academic success

• Employment opportunities

• Financial gain

• Admission to educational institutions

• Leadership positions

• Athletic achievement

• Personal transformation

Zero Boundary provides opportunities for learning; individual outcomes depend on multiple factors beyond its reasonable control.

146. Complaints & Incident Reporting
Parents and Participants are encouraged to report any concerns, incidents, or grievances promptly.
Zero Boundary shall endeavour to:

• Listen impartially.

• Conduct reasonable enquiries where appropriate.

• Treat all parties fairly.

• Maintain confidentiality where reasonably possible.

• Seek constructive resolution.

Submission of a complaint does not automatically establish liability.

147. Cooperation During Investigations
Participants and Parents agree to cooperate reasonably during investigations concerning:

• Safety incidents

• Medical emergencies

• Behavioural concerns

• Property damage

• Alleged policy violations

• Complaints

Failure to cooperate may affect Zero Boundary's ability to resolve the matter effectively.

148. Survival of Obligations
The following provisions shall continue to remain effective even after completion, cancellation, or termination of a Program:

• Payment obligations

• Confidentiality obligations

• Intellectual property protections

• Privacy obligations

• Indemnity provisions

• Dispute resolution provisions

• Limitation of liability clauses

• Any rights or obligations that by their nature are intended to survive termination.

149. Parent Acknowledgement
By registering a Participant for a Zero Boundary Program, the Parent/Guardian acknowledges that they:

• Understand the inherent nature of experiential learning.

• Recognise that reasonable care cannot eliminate every risk.

• Accept the limitations of liability described in this Chapter.

• Understand their responsibility regarding insurance and medical expenses.

• Agree to cooperate with Zero Boundary in managing risks and resolving incidents.

• Have carefully read and voluntarily accepted the provisions contained in this Chapter.

Chapter 10 – Legal Provisions, Dispute Resolution & Miscellaneous Terms

150. Purpose of this Chapter
This Chapter contains the legal provisions governing the interpretation, enforcement, and administration of these Terms & Conditions.
Its purpose is to establish a clear legal framework for resolving disputes, interpreting contractual obligations, protecting the rights of all parties, and ensuring the continued enforceability of this Agreement.

151. Compliance with Applicable Laws
Zero Boundary shall conduct its Programs in accordance with the applicable laws of the Republic of India.
Participants and Parents/Guardians agree to comply with all applicable laws, regulations, government directives, and lawful instructions relevant to participation in any Program.

Nothing contained in these Terms shall be interpreted as excluding any legal rights that cannot lawfully be excluded under Indian law.

152. Governing Law
These Terms & Conditions, together with all related policies, declarations, consent forms, and agreements issued by Zero Boundary, shall be governed by and interpreted in accordance with the laws of the Republic of India.

Where any conflict exists between these Terms and mandatory provisions of applicable law, the mandatory provisions of law shall prevail to the extent of such conflict.
 

153. Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable law and any valid dispute-resolution mechanism agreed between the parties, courts having territorial jurisdiction over the registered office of Zero Boundary shall have jurisdiction in relation to disputes arising out of or in connection with these Terms.

Nothing in this clause shall restrict, exclude or limit any statutory jurisdiction, remedy or forum that cannot lawfully be excluded or restricted, including any remedy or forum available to a consumer under applicable law.

154. Good Faith Resolution
Before initiating formal legal proceedings, Parents/Guardians and Zero Boundary agree to make reasonable efforts to resolve disputes through open communication and good-faith discussions.

Either party may notify the other in writing regarding the nature of the dispute and seek an amicable resolution.

Both parties shall endeavour to resolve such disputes fairly, respectfully, and within a reasonable period.

155. Mediation
If a dispute cannot be resolved through direct communication, the parties may mutually agree to refer the matter to mediation before commencing formal legal proceedings.

The objective of mediation shall be to encourage practical, fair, and mutually acceptable solutions while preserving constructive relationships wherever possible.

Participation in mediation shall not prejudice the legal rights of either party if mediation does not result in a settlement.

156. Arbitration
Where the parties have validly agreed in writing to refer a dispute to arbitration, such dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.

Unless otherwise agreed in writing and subject to applicable law:

• Arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties.

• The seat and venue of arbitration shall ordinarily be the city in which Zero Boundary has its registered office.

• Proceedings shall be conducted in English unless otherwise agreed.The arbitral award shall be final and binding, subject to applicable law.

• Nothing in this clause shall prevent a party from approaching a court, consumer commission, statutory authority or other forum where such recourse is available as a matter of mandatory law. 

157. Notices
Any official notice under these Terms may be delivered through:

• Email

• Registered post

• Courier

• Official Website notifications

• Secure participant portal

• Any other written method approved by Zero Boundary

Notices shall be deemed delivered when reasonably capable of being received by the intended recipient.

Parents/Guardians are responsible for ensuring that their contact details remain accurate and up to date.

158. Electronic Acceptance
Parents/Guardians acknowledge that electronic acceptance of these Terms through online registration, digital signatures, electronic consent, payment confirmation, or other recognised electronic methods shall have the same legal effect as a handwritten signature, to the extent permitted by applicable law.

159. Severability
If any provision of these Terms is held by a court or other competent authority to be invalid, illegal, or unenforceable, such provision shall be modified or interpreted to the minimum extent necessary to make it enforceable.
If modification is not possible, that provision shall be deemed severed without affecting the validity or enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect.

160. Waiver
Failure by Zero Boundary to exercise or enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.

Any waiver shall be effective only if made expressly in writing by an authorised representative of Zero Boundary.

No single waiver shall constitute a continuing waiver of any subsequent breach.

161. Assignment
Participants and Parents/Guardians may not assign or transfer their rights or obligations under these Terms without the prior written consent of Zero Boundary.

Zero Boundary may assign or transfer its rights and obligations to a successor organisation, affiliate, or authorised entity, provided that such transfer does not materially reduce the protections afforded to Participants.

162. Relationship of Parties
Nothing contained in these Terms shall be interpreted as creating:

• Employment

• Partnership

• Joint venture

• Agency

• Franchise

• Fiduciary relationship

between Zero Boundary and any Participant or Parent/Guardian.

Participation in a Program establishes only the contractual relationship described in these Terms.

163. Independent Contractors
Zero Boundary may engage independent instructors, consultants, trainers, facilitators, volunteers, transportation providers, venue operators, or other service providers.

Such engagement does not automatically create an employment relationship between Zero Boundary and those individuals or organisations.
Each independent contractor remains responsible for complying with applicable legal and professional obligations relevant to their services.

164. Language & Interpretation
These Terms are drafted in English.

Where translated versions are provided for convenience, the English version shall prevail in the event of any inconsistency, unless otherwise required by applicable law.

Headings are included solely for convenience and shall not affect the interpretation of these Terms.

165. Entire Agreement
These Terms & Conditions, together with all associated documents issued by Zero Boundary, including but not limited to:

• Privacy Policy

• Parent Consent Forms

• Medical Declaration

• Behaviour Policy

• Refund Policy

• Safety Guidelines

• Risk Acknowledgement

• Code of Conduct

• Child Protection Policy

• Any Program-specific policies

constitute the complete agreement between Zero Boundary and the Participant/Parent regarding participation in the Program.

No oral statement, advertisement, brochure, or informal communication shall modify these Terms unless expressly confirmed in writing by Zero Boundary.

166. Amendment of Terms
Zero Boundary reserves the right to amend, update, or revise these Terms from time to time in response to:

• Changes in law

• Safety requirements

• Operational improvements

• Educational developments

• Technological advancements

• Organisational changes

Unless otherwise required by applicable law or expressly permitted under these Terms, amendments shall operate prospectively and shall not retrospectively alter rights or obligations that have already accrued. 

Updated versions shall be published on the official Website and shall become effective from the date specified therein.

For significant changes affecting existing Participants, Zero Boundary shall endeavour to provide reasonable notice.
 

167. Survival
The following provisions shall continue to remain effective even after the completion, withdrawal, cancellation, or termination of a Program:

• Privacy obligations

• Intellectual Property rights

• Confidentiality obligations

• Payment obligations

• Indemnity provisions

• Limitation of Liability

• Dispute Resolution

• Governing Law

• Jurisdiction

• Any rights or obligations intended by their nature to survive termination.

Parents and Participants are encouraged to contact Zero Boundary promptly whenever clarification is required regarding any aspect of these Terms.

169. Final Parent & Participant Declaration
By registering for, enrolling in, making payment towards, or participating in any Zero Boundary Program, the Participant and the

Parent/Guardian jointly acknowledge and confirm that:

• They have had a reasonable opportunity to review these Terms before completing registration; 

• Their acceptance of these Terms is subject to applicable law and does not constitute a waiver of any right or remedy that cannot lawfully be waived. 

• They have carefully read these Terms & Conditions in their entirety.

• They understand the nature and purpose of Zero Boundary's experiential learning Programs.

• They have had the opportunity to seek clarification regarding any provision they did not understand.

• All information provided during registration is true, complete, and accurate.

• They voluntarily accept the rights, responsibilities, and obligations described in these Terms.

• They agree to comply with all policies issued by Zero Boundary.

• They understand that these Terms form a legally binding agreement between themselves and Zero Boundary.

We recognise the trust placed in us by Participants and their families and strive to honour that trust by acting responsibly, transparently, ethically, and with genuine care for every individual entrusted to our Programs.

These Terms & Conditions are intended not only to define legal responsibilities but also to reflect the values upon which Zero Boundary is built—curiosity, courage, responsibility, respect, resilience, and the belief that meaningful learning begins where comfort ends.
